CLAT 2020: Urgent application in SC seeks clarification on provision of isolation rooms at exam centres for COVID affected aspirants

An urgent application has been moved before the Supreme Court seeking clarification on the aspect of facilities for isolation rooms at CLAT exam centres to enable the applicant, who is infected with COVID-19, to write the exam..On September 21, the Supreme Court had ruled against NLSIU's NLAT and directed for CLAT to be held as per schedule. However, the applicant is under isolation and is required to be so on account of having contracted the novel coronavirus..It is stated in the application that the applicant was under a bona fide impression that the exam centres would have isolation centres for symptomatic candidates. .He submits that he was assured by the Vice-Chancellor of NLSIU, Bangalore on this count via a public statement in July this year on this issue, prior to the NLSIU briefly breaking away from the CLAT set-up for this year..However, in the new set of instructions issued, the Consortium has excluded candidates who are under isolation and as such, the applicant would not be permitted to take the entrance exam scheduled to be held on Monday. The applicant submits,."The sudden change in the stand of the Consortium of the National Lw Universities has deprived the applicant of his fundamental right under Article 14 of the Constitution to be treated as an equal and be given the opportunity to appear in the examination on 28.09.2020 when otherwise he was well entitled to like any other student.".Owing to this contingency, the applicant has filed an urgent application before the Supreme Court praying for a clarification in its judgment of September 21 where the Court, among other things, had directed for the CLAT to be held as per the schedule and for the entrance exam to be held in accordance with the SOPs issued by the concerned Ministries with respect to COVID-19..No reason for NLSIU to declare zero year, home-based online test could not have ensured transparency: The Supreme Court's NLAT verdict.The application is filed through Advocate Garima Prashad.
