Delhi Court grants bail to suspended J&K DSP Davinder Singh in terror case as Delhi Police fails to file charge sheet

A Delhi Court today granted bail to suspended Jammu and Kashmir DSP Davinder Singh who was arrested while ferrying two Hizb-ul-Mujahideen terrorists in a vehicle on the Srinagar-Jammu Highway earlier this year. (State vs Davinder Singh).Bail was also granted to accused Irfan Shahi Mir. .The order was passed by Additional Sessions Judge, Dharmender Rana. .Davinder Singh was arrested on March 14, 2020 pursuant to an FIR by the Special Cell of Delhi Police for the alleged commission of offences under Section 18 of UAPA and Section 120-B IPC. .As per the FIR, youths of Jammu & Kashmir and Punjab were being trained to carry out terrorist activities in the country and that there was a plan to execute terror attacks in Delhi. .The FIR apprehends the involvement of D-Company and Chhota Shakeel in funding a pro-Khalistan terrorist organisations in Punjab..Before Court, counsel for Davinder Singh and Mir argued that he was entitled to be released on statutory bail as the 90-day period for filing a chargesheet was over. .In its status report before the Court, Delhi Police also stated that a chargesheet had not been filed as the investigation in the case was yet to be completed. .In view of the above, the Court ordered, ...considering the fact that despite the lapse of statutory time limit to complete investigation, chargesheet in the instant matter has not been filed till date, both the applicants/accused persons namely Davinder Singh and Irfan Sahfi Mir are entiled to be released on bail on furnishing PB/SB in the sum of Rs 1,00,000/- each with two sureties each in the like amount to the satisfaction of the Ld. MM/Ld Duty MM/Ld.
