The Delhi High Court today issued notice in a petition challenging the election of Deputy CM Manish Sisodia in the Assembly Elections. (Ravinder Singh Negi vs Manish Sisodia & Ors).The Election Petition has been preferred by the runner-up from Sisodia’s Patparganj constituency, Ravinder Singh Negi..Notice was issued to Sisodia and Election Commission by a Single Judge Bench of Justice V Kameswar Rao..Negi has sought a direction to set aside the election of Sisodia on the ground that Sisodia and his agents indulged in ‘corrupt practices’ during the course of the election process in terms of Section 123 of the Representation of People Act, 1951..It is alleged that Sisodia “blatantly flouted” the law which materially affected the outcome of the Assembly Election..The Petitioner has claimed that in the affidavit filed by him before the Election Officer as well as in the nomination paper, Sisodia deliberately concealed information regarding the pendency of a criminal case against him under Prevention of Insult to National honor Act, 1971..The Petitioner has added that although "FIR is complete", being the Deputy Chief Minister of Delhi, Sisodia has not allowed the police to file chargesheet in the matter..The Petitioner has also claimed that Sisodia’s nomination paper was defective and even the information with respect to his residential address was false..Further, it is contended that Sisodia was also in violation of Section 126 of the Representation of People Act, 1951 which prohibits public meetings during period of forty-eight hours ending with hours fixed for conclusion of polls..The matter would be heard next on May 29..The Petitioner was filed through Advocate Sudhadhar Kumar.
