Delhi High Court directs trial court not to consider Satyender Jain's medical report from Delhi govt hospital while deciding his bail

The Delhi High Court on Thursday directed the trial court not to consider Delhi minister Satyender Jain's medical report received from Delhi Government's Lok Nayak hospital (LNJP hospital) while considering his interim bail application. .Single-Judge Justice Jasmeet Singh issued notices on Enforcement Directorate (ED) plea for medical examination of Jain at an "independent hospital" like All India Institute of Medical Sciences (AIIMS) or Ram Manohar Lohiya (RML) hospital and listed the case for further hearing on August 17. "It is directed that the special judge shall not consider the medical report from LNJP till the next date of hearing,” the Court directed..Additional Solicitor General (ASG) SV Raju, appearing for ED, argued that Jain is taking advantage of his ministerial post. He argued that it has been 46 days since Jain was arrested but he has not spent even a single day in jail."For 46 days he has taken advantage of being minister. He was arrested on May 30. He was remanded to judicial custody on 13 June. He has been in judicial custody since then. Till today it has been 46 days. He got himself admitted for 26 days in LNJP and before that he spent 20 days in jail dispensary,” it was argued.Raju also cited the incident of West Bengal minister Partha Chatterjee where the Calcutta High Court passed a direction not to admit him into a State run hospital but instead take him to AIIMS Bhubaneshwar. .The ED has approached the Delhi High Court against trial court orders allowing Delhi Minister Satyender Jain to be medically examined and admitted into Delhi government’s Lok Nayak Hospital.The federal agency has said that Jain should be medically evaluated by an independent hospital like All India Institute of Medical Sciences (AIIMS) or Ram Manohar Lohia Hospital because there is a likelihood of Jain’s medical report from a Delhi government hospital being tutored since Jain is a minister with the Delhi government..It was stated that Jain holds the post of the Minister of Health and his picture continues to be on the website of the Lok Nayak Hospital as well as on the plaque in the hospital commemorating the inauguration by Jain as the guest of honour.The petition further alleged that when the investigating officer (IO) went to the Lok Nayak Hospital to ensure that Jain appears before the vacation judge through video conference, he was found to be sleeping on the patient bed without any cannula on his hand and even multi-parameter patient monitor was switched off and he was not monitored by any medical instrument.His wife was present in the room and when the IO reached the room, Jain immediately wore the oxygen mask, the BP apparatus belt and monitor was switched on, the plea stated..Medical examination of Satyendar Jain should be by "independent hospital" like AIIMS: ED to Delhi High Court
