"Cannot go scot-free:" Delhi High Court on man who allegedly created 3 fake FB accounts to harass woman

The Delhi High Court on Thursday took an unfavourable view of a plea by a man who sought quashing of a first information report (FIR) against him for allegedly creating three fake Facebook accounts with a view to harass a woman (Deepak K.C. vs. State)..Justice Subramonium Prasad observed that the accused in such cases should not be allowed to go scot-free.However, the Court did not dismiss the plea instead asking the accused to file an affidavit stating that he has taken down the fake accounts. .The accused, in this case, had prayed that the FIR be quashed on the ground that a compromise had been reached between the accused and the complainant. However, the Court noted that it is possible that such compromise may have been arrived at due to duress.."How does one conclude that the three IDs were brought down? Maybe the complainant is being harassed and has thus compromised. No girl wants to come to the police station everyday. However, I cannot allow the accused to go scot-free," the judge remarked..The Court noted in its order that some of the fake Facebook accounts were still operational and that "the complainant has also stated that she is under constant threat from the petitioner that he will make more fake IDs.".The Court went on to direct the accused to file an affidavit stating that he has taken down all the fake accounts he had created on Facebook.."Let an affidavit be filed by the petitioner stating that he will not harass the woman by any means and also stating that he has closed the two remaining fake IDs. The blocked IDs are to be verified by the police," the Court ordered..Appearing on behalf of the State, Additional Standing Counsel for the Delhi government, Avi Singh, submitted that this was a case where Facebook IDs were created in the name of the complainant..The Court was informed that the Investigating Officer had blocked these fake accounts. The Court opined that the same must be verified by the Delhi Police.."The police must verify. The man cannot go scot free. Let the IO verify the correctness of the averments made in this application," the Judge said..Thereafter, the matter was listed for hearing on November 29, 2021..Advocate Anand Kumar Pandey and Manish Kumar Jha represented the petitioner, Deepak KC.
