The Delhi High Court on Wednesday granted interim bail to former Bharatiya Janata Party (BJP) MLA and Unnao rape case convict Kuldeep Singh Sengar to enable him undergo a cataract surgery [Kuldeep Singh Sengar vs Central Bureau Of Investigation]..A Bench of Justice Navin Chawla and Justice Shalinder Kaur ordered that Sengar be released on interim bail on Thursday so that he can be admitted to All India Institute of Medical Sciences (AIIMS) on Friday."If surgery is not conducted on January 24, Sengar directed to surrender to jail that day," the Court ordered..The Court further ordered that a Delhi Police constable be stationed outside Sengar's ward at the AIIMS. He has been directed to surrender on January 27. "Needless to say, no further extension shall be granted," the Court clarified..This is the second instance of Sengar being released on medical bail.The Court had initially granted Sengar interim bail on medical grounds till December 20, 2024, for medical assessment of his condition by AIIMS.Thereafter, the medical bail was extended by 4 weeks, till January 20 with the observation that no further extension would be granted.Sengar had surrended before Tihar Jail authorities on January 20 after expiry of his medical bail..He then moved the Court again with regard to the cataract surgery. He sought suspension of sentence for 30 days for the procedure.Senior Advocate Manish Vashisht submitted that Sengar’s eyes need immediate attention. "He suffers retinal issue for which he needs urgent cataract surgery and laser therapy," the Court was told.Advocate Mehmood Pracha, appearing for the complainant, opposed the application seeking interim bail. He submitted that the Court had earlier declined to extend his medical bail."Even if the Court had denied further extension of bail, heavens will not fall if he is allowed. He can surrender back the same day," Justice Chawla said..The Court then granted Sengar interim bail till January 27. The order was passed on the application moved in the appeal challenging his conviction in the rape case..Meanwhile, Sengar's application seeking suspension of sentence in the case of custodial death of victim's father was also listed for hearing today.Justice Vikas Mahajan granted the victim's counsel time to respond to the plea.
