Delhi High Court grants interim relief to Karisma Kapoor, restrains Priya Kapur from alienating Sunjay Kapur's assets

The Court said that the onus is on Priya Kapur to clear doubts raised over Sunjay Kapur's will and till the time that is done, his assets cannot be dissipated.

The Delhi High Court on Thursday allowed an interim injunction plea filed by Bollywood actor Karisma Kapoor’s two children and restrained their stepmother, Priya Sachdev Kapur, from creating any third-party rights over the assets left behind by late industrialist Sunjay Kapur.

Priya Kapur is the widow of Sunjay Kapur who passed away in 2025. Sunjay was earlier married to Karisma Kapoor before divorcing her and marrying Priya Kapur.

Justice Jyoti Singh on Thursday said that Karisma Kapoor and Sunjay Kapur's mother, Rani Kapur, have raised suspicions over the validity and the authenticity of the will purportedly left by Sunjay, and therefore, the onus is now on Priya Kapur to clear those suspicions.

The Court said that since the validity of the will is now a matter of trial, which will take time, Sunjay Kapur's assets must be prevented from dissipation.

"Assets should not be dissipated. The assets need to be preserved," the Court said while adding that Karisma Kapoor had made a prima facie case for the grant of an interim injunction.

Therefore, the Court restrained Priya Kapur from alienating, transferring, pledging, changing the equity or shareholding of Sunjay's Indian companies.

"I have restrained her from withdrawing the provident fund amount, something thas consented to. I have also restrained from alienating personal effects, artwork, etc., which too was consented to," Justice Singh said.

She added,

"I have restrained from withdrawing money from three bank accounts of the two Indian banks, save and accept to the extent of discharging liabilities towards the children, under the degree of divorce between the deceased and the mother of the children."

The Court has also stopped the operation of the foreign bank accounts and cryptocurrencies held by Sunjay Kapur.

However, the Court clarified that its order does not extend to immovable properties held by Sunjay Kapur abroad.

Karisma Kapoor's children have accused Priya Kapur (third wife of Sanjay Kapur) of forging Sunjay Kapur's will and trying to gain total control of the assets.

Karisma Kapoor and Sunjay Kapur were married for 13 years, between 2003 and 2016 before getting divorced. They have a son and a daughter together.

The children, represented by their mother, moved the Court arguing that they were wrongfully excluded from Kapur’s estate by Priya Kapur following his sudden death in June 2025 while in the United Kingdom.

The suit names Priya Kapur, her minor son, his mother Rani Kapur and the executor of the will, Shradha Suri Marwah, as defendants.

Central to the dispute is a will dated March 21, 2025, which allegedly leaves Sunjay Kapur’s entire personal estate to Priya Kapur.

The children claimed before the Court that their stepmother conspired with two associates, Dinesh Agarwal and Nitin Sharma, to suppress the will for over seven weeks before revealing it at a family meeting on July 30, 2025.

It was argued that the will is forged and fabricated. According to the plea, Priya Kapur’s conduct demonstrates an attempt to “usurp full control” over Sunjay Kapur’s estate to the exclusion of other legal heirs.

The children asked the Court to declare them as class I legal heirs and to pass a decree of partition granting them a one-fifth share each in their father’s assets.

As interim relief, they sought an order freezing all personal assets belonging to Sunjay Kapur until the matter is resolved.

Priya Kapur refuted these claims and argued that the will is genuine and that the allegations that it was forged by her are completely wrong.

She said that errors in the will do not invalidate it. Further, her counsel argued Karisma Kapoor's children have gotten their share in the Kapur family trust.

Senior Advocate Rajiv Nayar appeared for Priya Kapur and stated that Karisma Kapoor has tried to build a story that there was nothing wrong in her relationship with Sunjay Kapur, but that assertion was wrong. 

It was stated Karisma Kapoor and Sunjay Kapur’s marriage culminated in a bitter divorce after which she was “nowhere to be seen”.

After considering the arguments by both sides, the Court today granted relief to Karisma Kapoor's children.

Priya Sachdev Kapur and her minor son were represented by Senior Advocates Rajiv Nayar, Akhil Sibal and Shyel Trehan. They were briefed by Bahuguna Law Associates through Senior Partner Meghna Mishra, Partner Designate Ankit Rajgarhia, Principal Associate Tarun Sharma and Associate Rohit Kumar.
