The Delhi High Court is hearing a petition concerning the COVID-19 situation in the national capital region..While listing it for a post-lunch hearing, the Bench of Justices Vipin Sanghi and Rekha Palli has sought information from the Centre on the issue of shortage of oxygen. The matter is slated to be taken up at 3:15 pm. .Live updates of the hearing today feature here. .Court: Industries can wait. Order has been passed on 18th on banning use of oxygen in industries..There is an empowered group II.. it's a high powered group: Vinayak Why 22nd? There is a formula for determining oxygen requirement i.e 10 L per min : Vinayak.Based on formula, 220 MT oxygen is the requirement for Delhi. These figures bare ballpark. Sometimes in anticipation people go to hospitals. Delhi has been given 378 MT oxygen: Vinayak.If centralised planning is not done, States with plants will not give it to other States. There is monitoring.. for 12 high burden States, allocation was decided: Vinayak.We are in constant touch with the nodal officer. Oxygen will continue to be distributed.. there may be some misuse though it is a wrong word.. commerical packaging takes away oxygen from hospitals. Kerala, MP .. they are following guidelines of rational use of oxygen: Vinayak.If a patient has 95 oxygen, and you are giving oxygen.. it will do more harm. Best practices of States are being discussed: Vinayak.There is installation of PSA plant. To produce oxygen. 162 plants were sanctioned for across India. Entire cost of Rs 200 crore is borne by Central Government: Court.It was sanctioned in December. On a weekly basis, Centre is holding video conferences. Perhaps importance of PSA was not appreciated in Jan-Feb. Delhi has 8 such plants..: Vinayak.Vinayak gives details of the plants in Delhi.. At 6 places, you have site clearance. Nearly 3k MT was used for industrial.. now that there will be a ban.. how much these exempted industries use, it is not exactly known. Remaining will be additionally available : Vinayak.Petroleum, Steel would be the big guzzlers.. maybe you can ask them to cut down. What is the point of producing if there is a longer lockdown: Court.Economic interest can't override human lives. We have to understand this. This is a sensitive matter. Most drugs are produced overseas. It will discourage manufacturers to register is India. You have to exercise carefully. Same should be circulated: Court.The affidavit has firstly dealt with aspect of beds made available by Centre in Delhi: Court records.500 DRDO beds will be established in Delhi cantt. 250 already in operation. 25 medical officers, 75 para medics to be provided from armed forces : Court.Court records Centre sought ventilator requirements from States..Availability of COVID beds as on 19.4.2021 in Centre hospital is provided. We seriously contest.. 12k beds are Private hospitals. What he's saying that Private hospitals don't know when you administer oxygen : Mehra.He's talking about Kerala. Maybe there is something to learn : Court Mr Vinayak's words can't be the final word. Ganga Ram is not a government hospital. Max ran out of oxygen.. : Mehra.While matter was going on, a colleague sent an NDTV report saying Ganga Ram will run out if oxygen in 8 hours : Justice Palli.We are not saying don't take medical decisions. He is saying there are some efficient practices: Court Mehra urges court to not record it in the other..Directions may be passed to give oxygen to Ganga Ram : Malhotra.It's equal everywhere in all hospitals: Mehra It's Apollo. It's everywhere: ASG Sharma.IOCL is willing to give oxygen but it needs NoC from Delhi Government: Malhotra I had some input that IOCL wanted to supply : ASG Sharma.We are informed that oxygen supply to various hospitals in Delhi is about to get exhausted in 4-8 hours. Decision taken by centre to divert oxygen is to be implemented only from 22nd. We do not find any justification for the same: Court.Need is now. Any delay will lead to loss of precious lives. We direct Centre to implement the decision forthwith and provide the supply to oxygen who are running out : Court.Since Inox has not complied with our order. We issue notice of contempt to Inox. We direct MD/owner to remain present tomorrow. State of UP through Chief Secretary be also present: Court.[Ramping up testing aspect] There are certain aspects that need to be addressed by Central Government and its agencies: Court.We are informed that RT-PCR test equipment are imported and the machines are dealt with routinely by customs at Port. It is essential that all such medicines etc are cleared on top priority. We direct Centre to issue necessary directions forthwith: Court.Procedure for clearance is highly time consuming. We do not wish to impinge on ICMR authority and we don't expect it to relax its standards. However we direct ICMR to give top priority to such clearances for setting up/expanding RTPCR test labs : Court.Next is the software device for uploading test results. Patients are required to give aadhaar card. Despite this, we are informed that agencies are required to fill details online.. we direct Centre, ICMR to review the form in which info is to be given by agencies: Court.This appears to be acting as a bottleneck in preparation of reports : Court.We have also noticed reports about the critical medicines falling in short supply and being sold in premium in black market : Court.We direct Centre and its agencies particularly the Drug Controller to issue necessary directions to all licensees. Government should undertake checking on regular basis to unearth all such cases of hoarding : Court.The affidavit discloses that for Remdesivir, 10.4 lakh vials were supplied to all States and UTs in last ten days.. DGCI has granted permission for manufacturing at 20 additional sites : Court.Centre should dynamically review distribution of Remdesivir to States and UTs on the basis of the need/serious active COVID patients: Court.This is essential to maximize efficient use of life saving drug : Court.There are a number of other drugs which are in use such as Ivermectin, Dexamethasone, Prednisolone..as per news reports, there is shortage.. looking at the emergent situation, we direct Centre to interact with the manufacturers/patent holders/licensees to ramp up capacity: Court.We may take note of the fact that the Patent Act provides for compulsory licensing under Section 84.. section 92 .. Section 100. Looking at the present day situation, there can be no doubt that a case is made out for exercise of this power : Court.Interest of Patent holder should be kept in mind : Court.Best course would be to encourage the existing manufacturers to ramp up their production on a war footing. They should be encouraged to grant voluntary license to manufacture: Court.If such efforts do not fructify, the Government/Controller should not hesitate to invoke their power under Patent Act since lives of the people which are being lost at a very fast pace take priority over everything else: Court.Such patent holders can be compensated by fixing a fair licence fee : Court .Report progress by day after tomorrow: Court.[On Vaccine wastage] As per one report, as many as about 44 lakh vaccine have been wasted out of ten crore.
