Delhi High Court bars Spread Home from using Louis Vuitton trademark

The Delhi High Court on Wednesday barred home décor and furnishing company Spread Home from using certain registered trademarks belonging to ultra luxury apparel maker Louis Vuitton (LV) on the former's products such as bed sheets, quilts, pillow covers among others [Louis Vuitton Vs Spread Home Products Pvt Ltd]..Justice Mini Pushkarna passed the interim injunction order against Spread Home after noting that Louis Vuitton had made out a prima facie case for the grant of interim relief. "Counsel appearing for plaintiff (Louis Vuitton) has shown flower in monograms are registered in favour of plaintiff ... and documents showing use of infringing mark by defendant is registered. In the above circumstances the plaintiff has demonstrated a prima facie case for injunction," the Court said. .The dispute pertained monogram flower marks owned by Louis Vuitton for over four decades. LV has contented that Spread Home, while branding itself as Spread Spain, is using these flower marks on their products and benefitting financially from infringing LV's registered marks.LV added that these marks form an important part of its product range and that Spread Home may create a misconception in the minds of consumers by using the monogram flower marks. .Spread Home is a company selling home décor and furnishing products. Established in 1999, it offers products such as bedding, bath accessories, and décor items including bed linens, quilts, pillows, bath mats, towels, furniture, and storage organisers. The company sells its products online as well as offline.In response to LV's trademark infringement suit, Spread Home contended that while products bearing the flower marks may have been available in the past, the company stopped selling them sometime back. The decor company's counsel further argued that Spread Home was not a fly by night operator and has been in the market for 25 years. LV's lawyers retorted that they had themselves purchased infringing products from Spread Home eight times over the last one month alone. .The Court, therefore, passed an order restraining Spread Home from selling any more of such products bearing the monogram flower marks. "In the above circumstances, the plaintiffs have demonstrated a prima facie case for grant of injunction and, in case, no ex parte ad interim injunction is granted, the plaintiffs will suffer an irreparable loss. Further, balance of convenience also lies in favour of the plaintiffs, and against the defendants," the Court added. .The Court also directed Spread Homes to file statement of accounts showing sales of their goods, since they started using the designs complained of, to ascertain damages, if any, to be paid to LV.The case is listed next in April 2025.Over the last two years, the Delhi High Court has been issuing various orders to curtail the sale of counterfeit LV products. In 2023, the court directed two individuals to pay ₹9.59 lakh to LV for selling such counterfeit products..LV was represented by Advocates Pravin Anand, Dhruv Anand, Udita Patro, Nimrat Singh and Dhananjay Khanna from Anand & Anand.
