ED moves Delhi High Court against order allowing Satyendar Jain to have counsel present during interrogation

The Directorate of Enforcement (ED) has approached the Delhi High Court challenging the condition imposed by a special court that a counsel should be present with Delhi Minister Satyendar Jain while he is being interrogated by the agency..Advocate Zoheb Hossain appeared for the ED and mentioned the plea before Acting Chief Justice Vipin Sanghi. "ED was granted remand on May 31. Certain conditions have been laid down like presence of lawyer and others. This will vitiate the custody granted to us," Hossain said.The Court agreed to hear the matter on Friday. .A special court had last week granted custody of Jain to ED till June 9. However, on request of his counsel, the Court said that a lawyer should be present during Jain's interrogation at a distance from where he could see the proceedings, but not hear them."...considering the facts and circumstances, it is directed that during time of enquiry/interrogation from the accused one advocate of the accused shall be allowed to remain present at a safe distance where from he can see the accused but not hear him," Special Judge (PC Act) Geetanjali Goel said in her order. .Jain, who had been facing a probe in a corruption case registered by the Central Bureau of Investigation (CBI), was arrested by ED sleuths in a related money laundering case.Jain is a senior Aam Aadmi Party (AAP) politician and currently holds the health, home, power, public works department, industries, urban development and flood, irrigation and water portfolios in the Delhi government as a minister..ED has alleged that he is involved in a money laundering case, and that there is no clarity as to who the beneficiaries of this laundered money are. It has also been alleged that this is not a one time offence. "This is of a recurring nature which may still be going on. He may be able to throw light during custodial interrogation," Solicitor General Tushar Mehta had told the special court. .However, Jain has said that the ED has not been able to point out any source of income, even in the CBI case."No evidence to show that money from me went (hawala). His house been searched on two occasions. His bank accounts also seized. The entire material is with them. I'm given share in these companies as a consultant. I was architect. What company does is none of my business. Even today it's same share percentage.
