Importantly, the Court held that examination of a smartphone or email is in the nature of a search and would therefore require a search warrant.

The Karnataka High Court recently held that an investigating officer has no right to disclose the private data seized from the smartphones or electronic gadgets of an accused to a third party, without the written permission of the concerned court (Virendra Khanna v. State of Karnataka).
