Madras HC to partially resume physical Court hearings from September 7 [Read Notification]

The notification issued by the High Court on Saturday states that six Benches of the Principal Madras Bench and two Benches at the Madurai Bench will conduct physical hearings from September 7.

Following a meeting of the Administrative Committee of the Madras High Court earlier this week, it has been decided that some Benches of the Madras High Court will resume physical court hearings from September 7. Other Benches would continue hearing matters virtually.

The notification issued by the High Court on Saturday states that six Benches of the Principal Madras Bench and two Benches at the Madurai Bench will conduct physical hearings from September 7.

In order avoid overcrowding in courts and minimise the risk of COVID-19 spread, the physical Bench sittings at the princpal Bench will be split into pre and post lunch sessions.

The notification states,

"In order to meet the growing demand of physical court hearing and also keeping in view the precautions that are required to be observed for avoiding any untoward happening, Hon’ble the Administrative Committee on a series consideration has decided to open physical court hearing partially with Six Division Benches at the Principal Seat at Madras and Two Division Benches at the Madurai Bench, with a combination of physical court hearing and virtual court hearing with effect from 7.9.2020."

The notification further intimates:

  • The physical court hearing of three Division Benches in the Principal Seat at Madras will be in the pre-lunch session and three Division Benches in the post-lunch session in order to avoid overcrowding in Courts.

  • Virtual court hearings will alternatively be conducted for the rest of the day.

  • Thus, Benches would be functioning for half a day through physical court hearing and for the next half a day through virtual court hearing to facilitate lawyers of both categories, who opt for physical court or virtual court hearings.

  • This will be adopted on a trial basis in order to asses the feasibility of running of physical court hearings, which can be suitably varied after observing the functioning of the Courts in this manner for two weeks.

  • The other Benches will continue to function through virtual court hearing
