No directions can be given to Police laying down "guidelines of good behaviour", Delhi HC

The Delhi High Court has stated that it cannot give directions to the Police laying down the "guidelines of good behaviour". .The order was passed by a Division Bench of Chief Justice DN Patel and Justice C Hari Shankar in a public interest litigation by a second-year LL.B student..Amongst several other reliefs, the Petitioner had sought framing of “proper rule and regulation for entertaining informant with good behaviour so that informant can approach police authorities without any hesitation”..Refusing to pass any such directions, the Court remarked,.“..no direction can be given to the police laying down the guidelines of good behaviour. It appears that in the mind of the petitioner there is a wrong presumption about the behaviour of the police. However, no such order can be passed on presumptions and surmises.”Delhi High Court.In response to Petitioner's prayers seeking compliance of the Supreme Court's order in Lalita Kumari vs State of UP, the Court observed that the Police was expected to follow and was bound by the guidelines propounded by the Supreme Court..Stating that there was "every presumption" that the Police was “following the law scrupulously”, the Court iterated,“The details of the Criminal Procedure Code are bound to be followed by the police. Over and above, the statutory and mandatory duty of the police is already pointed out in the Criminal Procedure Code.”.The Court clairifed that as and when violation of such principles/law is pointed out in an individual writ petition or in an individual matter, all care can be taken by the Court to address the issue..The Court opined that no general guidelines could be issued with respect to mandatory complaince of the Code of Criminal Procedure..It said,.“Violation of any provisions of Criminal Procedure Code can be taken care of but no general guidelines can be issued that respondent should follow Code of Criminal Procedure.. violation of any law should be pointed out categorically.”Delhi High Court .In view of the above, the Court concluded that there was no substance in the writ petition and the same was dismissed..Petitioner Srikant Prasad appeared in person..Read the Order:
