[BREAKING] No proposal under consideration to make Law Commission a statutory body: Law Ministry to Supreme Court

The Central government has informed the Supreme Court that there is no proposal under consideration to make the Law Commission of India a statutory body..An affidavit filed by the Department of Legal Affairs, Union Ministry of Law also stated that the Centre is currently seized of the matter regarding appointment of the Chairperson and members of the Law Commission..The reply was filed in a plea by BJP leader Ashwini Kumar Upadhyay seeking to declare the Law Commission of India as a "statutory body," as well as directions to appoint chairperson and members to the panel within a month..Further, the Centre submitted that the petitioner has approached the court with "unclean hands." The Centre thus urged the top court to dismiss the petition "with heavy costs" at "pre-admission stage only.".Upadhyay had also made an alternative prayer urging the top court to fill up the panel by itself."Alternatively, being custodian of the Constitution and protector of the fundamental rights, the Court may be pleased to use its plenary constitutional power to appoint the Chairperson and Members of the Twenty Second Law Commission of India and declare that the Law Commission of India is a statutory body," the plea said..He further prayed for a direction to the law panel to consider his submission seeking action on the Vohra Commission report on the alleged nexus between politicians and criminals.The petition also sought a direction to the Law Commission to treat the plea "seeking 100 per cent confiscation of black money, benami property and disproportionate assets and life imprisonment to looters as a Representation and prepare two separate reports within three months".
