[BREAKING] No need for a separate FIR on January JNU violence: Delhi Court dismisses plea by JNU Professor

Considering that the matter was already under investigation by Delhi Police, a Delhi Court has dismissed a plea seeking registration of FIR in connection with January 5 mob attack on the teachers, students and staff of the Jawaharlal Nehru University in the University campus. (Sucharita Sen vs State).The plea under Section 156(3) CrPC was preferred by JNU Professor Sucharita Sen, (Complainant) who had suffered injuries during the violence. .Pawan Singh Rajawat, Chief Metropolitan Magistrate, Saket noted that since the injuries suffered by the Complainant were the result of violent acts for which FIR had already been registered, no directions were required for registration of a separate FIR. .Pursuant to the Court's direction, Delhi Police had filed a status report in the matter, informing that its Crime Branch was already conducting investigation in connection with the January 5 attack. .Investigation in progress, only urgent matters being heard: Delhi Court refuses to advance date of hearing in plea for FIR in JNU Violence.Crime Branch stated that the probe by a special investigative team was in progress and all efforts were being made to identify all the attackers/assailants and to conclude the investigation in a time-bound manner..The Court acknowledged that whenever any act disclosed the commission of any cognizable offence, FIR had to be registered..In the present case, the Court observed that the basic grievance of the Complainant was that a separate FIR was not registered on her complaint..However, it was not pointed out by the Complainant whether she had any apprehension that her complaint will not be investigated in the already registered FIR ie. FIR No. 06/2020, especially when her statement u/s 161 CRPC has already recorded by the invetsugating agency, the Court added. . The Court thus opined, .The injuries suffered by number of persons including the Complainant was a result of violent act which forms part of same transaction for which FIR is already registered as it not only has proximity in time and place but also the damage to property and injuries suffered by the complainant and other persons..In view of the above, the Court ordered, .Hence, I am satisfied that no directions are required for registering separate FIR on the complaint made by the complainant..In view of the Delhi High Court order stating that the matter was sensitive in nature and needed to be probed thoroughly and expeditiously, the Court nonetheless directed the DCP (Crime Branch) to file a status report on the investigation in the already registered FIR. .The matter is listed for the purposes of the status report on December 19. .The plea was filed through Advocates Adit S Puri, Tara Narula and Kirti Awasthi. .Advocate Adit Pujari appeared for the Complainant. .Read the Order:
