Commercial private financial institutions which may be performing public duties not "State" under Article 12: Allahabad High Court
"That apart, since disputed question of facts are involved, we decline to exercise our extraordinary jurisdiction under Article 226", the Court added.
The Allahabad High Court recently clarified that private financial institutions that may be performing public duties are not covered under the definition of "State" under Article 12 of the Constitution of India.
Hence, a writ petition against such an entity is not maintainable before the High Court, it was ruled.
