Solicitor General Tushar Mehta tells the Court that all parties do not agree on the questions framed by the parties and suggests that the issues may be framed by the Court in chamber.

Senior Counsel Fali Nariman makes submissions before the Court, says that reference is to be made from a smaller Bench to a larger Bench; but the scope of review is limited to the point of checking any error apparent in a judgment.
