Slight penetration even if there is no visible injury will constitute rape: Sikkim High Court

"Penetration to any extent is sufficient to constitute rape under IPC and penetrative sexual assault under the POCSO Act," the High Court held.

The Sikkim High Court last week held that slight penetration of male sexual organ inside vagina will constitute rape and aggravated penetrative sexual assault even in the absence of any visible physical injury [Subash Chandra Chettri v State of Sikkim].
