PMLA cannot be invoked in tax evasion cases by simply alleging criminal conspiracy: Supreme Court

The Court was hearing pleas seeking reconsideration of its earlier judgment in Vijay Madanlal Choudhary v. Union of India, in which the validity of provisions of the PMLA was upheld.

The Supreme Court on Wednesday orally opined that the Enforcement Directorate (ED) cannot invoke the Prevention of Money Laundering Act (PMLA) for tax evasion cases since offences under the Income Tax Act are not scheduled offences under the PMLA.
