Stop attacking judges personally; if executive fails to implement court order, ridicule government: Kerala High Court

The Kerala High Court on Friday strongly condemned personal attacks on judges for the failures of the executive in implementing the orders of the court [St. Stephen's Malankara Catholic Church Kattanam Village v State of Kerala]..Justice Devan Ramachandran remarked that the High Court is made the scapegoat for all the shortfalls of the government even though it is abject failure of governance that the Court's orders are not implemented."This is the tragedy of the system. Everybody talks of democracy. A democracy, as we know, is built on pillars. Every pillar has to respect each other and must do what is required to be done. When a judgment or order is issued by the High Court it is to be implemented. If the executive fails to do so, don't ridicule the High Court, ridicule the government itself," he orally remarked..He also expressed dismay at the fact that sections of the public were ascribing personal agendas to judges."This trend of attacking judges personally has to stop. We have no agenda, except the agenda of democracy...This court tries do something for societal good and immediately some agenda is ascribed to it. What agenda does the High Court have?" Justice Ramachandran orally observed..The single-judge then stated that he himself had been made aware of some insinuations made against him both online and on other platforms."Merely because the High Court is reacting to social concerns doesn't mean you can attack me. If we decide to stop addressing these concerns, can you assure me the government will take steps? ...I am paying the price for being committed to social causes. There are a lot of jobless people who only sit and complain against the High Court for the government's inaction," he said..Justice Ramachandran made the observations in relation to some comments made about the judiciary and the judge himself after the Court delivered an order on Thursday regarding the ongoing Bharat Jodo Yatra led by Indian National Congress leader Rahul GandhiThe Court had pulled up the government and political parties for putting up illegal flags and posters during political rallies, leaving behind litter and increasing the risk of road accidents..In the order passed by it today, the Court observed that citizens are confused and they want the High Court to intervene at every stage whenever there is a violation. It went on to clarify that once the court has already passed orders, it is for the government and its agencies to implement."Ironically its a failure of government and its agencies which now causes some vested interests to speak accusingly against the High Court, when, admittedly, stringent orders have been issued....If orders of the Court are refused to be, or failed to be, implemented by agencies, then it spells doom for the well enshrined traditions of democracy," the Court said in its order.
