The Supreme Court on Monday rejected a petition seeking the removal of Aam Aadmi Party (AAP) leader Arvind Kejriwal as the Chief Minister of Delhi. .The plea was filed in light of Kejriwal's arrest by the Enforcement Directorate (ED) in the money laundering case connected to the Delhi excise policy case.A Bench of Justices Sanjiv Khanna and Dipankar Datta today said that the Court cannot go into such issues and it is up to the Lieutenant Governor of Delhi to look into it."How should we go into all this? Let the LG take action if he wants to. No legal right. Propriety, you may say ... that is all," the Bench remarked..The Delhi High Court had recently refused to entertain the plea seeking directions to remove Arvind Kejriwal as Chief Minister (CM) of Delhi following his arrest by the ED.The High Court had said that the petitioner before it was attempting to drag the Court into a political thicket and proceeded to say that it would impose costs of ₹50,000. This led to the instant appeal before the apex court.Kejriwal is currently out on interim bail after he was granted relief by the Supreme Court. However, he cannot discharge the functions of the Chief Minister, sign any official files or use the Chief Minister's office. .The plea before the High Court had said that Kejriwal, though incapacitated, was continuing to hold the office of the Chief Minister of Delhi which not only raised several constitutional complications but also violated the guarantee of the right to life of the people in Delhi.Earlier, on March 28, the High Court had rejected a similar public interest litigation (PIL) petition filed by one Surjit Singh Yadav.Thereafter, on April 4, the Court also refused to entertain another similar PIL by Vishnu Gupta, who is the president of Hindu Sena. The Court said it would be Kejriwal's personal call to continue as the CM or not.
