1. Arun Kumar & Anr. v. Supreme Court of India

A batch of petitions challenging the Advocate-on-Record system followed by the Supreme Court. The court had issued notice in the case on July 1, 2015 with Senior Advocates Ram Jethmalani, KTS Tulsi and Dinseh Dwivedi appearing for the petitioners.

2. Bar Council of India v. AK Balaji & Ors.

[Item 35 in court 3 – SLP(C) 17150-17154/2012

Bench: Anil R Dave J., AK Goel J.

Three petitions on permitting non-Indian law firms to practice within the country. When the matter was last heard, Senior Advocate Huzefa Ahmadi, (appearing for Global Indian Lawyers) informed the bench that service is not complete. Ahmadi also sought the Court’s permission to serve on the Central Government Standing Counsel for all the government respondents, which was allowed by the Court.

Today in court: The court has granted leave in the matter. The case will now be posted for final disposal. The Central government, through Solicitor General Ranjit Kumar, informed the court that it would file its reply setting out the policy of the government in this regard. Since, no time limit has been fixed by the Court, it is unlikely that the matter will be heard anytime soon. You can read the full report here.

3. Mahendra Singh Dhoni v. Jayakumar Hiremath

The appeal filed by MS Dhoni against a judgment of the Karnataka High Court which had rejected his petition to quash criminal proceedings initiated against him in for hurting religious sentiments. You can read more about the case here.

Today in court: The Court issued notice to the complainant and stayed the criminal proceedings pending before the Additional Chief Metropolitan Magistrate. Senior Advocate Subramonium Prasad appeared for Dhoni.

4. Common Cause & Ors. v. Union of India & Ors

[Item 301 in Court 9 – IA 13 in Writ Petition (Civil) 463/2012]

Bench: Madan B Lokur J., Kurian Joseph J., AK Sikri J.

Interim applications pertaining to the coal scam. At the last hearing, the Supreme Court had directed ML Sharma (ex-CBI Special Director) to complete the investigation into the conduct of ex-Director of CBI, Ranjit Sinha within 8 to 12 weeks.

Regarding Hindalco’s role in the coal block allocation scam, advocate Prashant Bhushan had submitted that the CBI has not probed any offence. The Court had then asked the CBI to update it about the steps taken in this regard.

Today in court: The Court today held that ML Sharma will have the power to summon anyone in connection with the investigation and directed Sharma to complete the investigation within 3 months. The Court also accepted Sharma’s request for three retired police officers and two support staff to assist him in the investigation. The Court will fix the remuneration to be paid to Sharma on November 16 which has been fixed as the date of next hearing.

5. Supreme Court Women Lawyers Association v. Manohar Lal Sharma and Ors.

[Item 303 in court 3 – Writ Petition (Civil) 138/2015]

The petition filed by Supreme Court Women Lawyers Association praying for restricting the entry of two lawyers – ML Sharma and AP Singh, into court premises. The court had issued notice in the case on March 24, 2015.

Today in court: The court directed the matter to be posted before the “appropriate Bench” on a non-miscellaneous day.

6. Manohar Lal Sharma Advocate v. Union of India & Ors.

Item 64 in court 13 – Writ Petition (Crl.) 162/2015]

This petition, filed by advocate ML Sharma, prays for special fast track criminal courts in every state for day-to-day proceedings in criminal cases against present and former MP’s and MLA’s.

7. Dayanidhi Maran v. The State by Deputy Superintendent of Police

The appeal filed by ex-Telecom Minister Dayanidhi Maran against a Madras High Court order rejecting anticipatory bail plea. When the matter was heard on August 12, the Supreme Court had stayed the High Court judgment cancelling Maran’s anticipatory bail and had issued notice to CBI.

Today in court: The court granted time to the parties to complete their pleadings and adjourned the matter to October 1.

8. All India Judges Association v. Union of India & Ors.

1. AX v. Union of India

[Item 6 in Court 9 – Writ Petition (Civil) 8622/2015]

Bench: RS Endlaw J. 

A petition filed by a TERI researcher who had levelled sexual harrassment charges against former TERI Chief RK Pachauri. While she had previously moved the High Court for cancellation of anticipatory bail granted to Pachauri, this petition seeks to challenge the manner in which TERI has been handling the entire issue and why no action had been taken against Pachauri so far.

On the last hearing, the Court wanted to know the source of TERI’s funding and whether it could be treated as a ‘State’ as per Article 12 of the Constitution.

Today in Court: The Bench directed for the matter to be posted before a Division Bench on September 21. Senior Counsels Rajeev Nayyar and Indira Jaising appeared for RK Pachauri & the petitioner respectively.
