Unnao Rape: SC orders transfer of case to Delhi, directs payment of Rs 25 Lakhs interim compensation [Live Updates]

The Supreme Court has ordered the transfer of five cases concerning the Unnao Rape from Uttar Pradesh to a competent court in Delhi. Further, the State of Uttar Pradesh has also been ordered to give Rs 25 lakhs as interim compensation to the victim.

Earlier today, the Bench of Chief Justice Ranjan Gogoi and Justices Deepak Gupta and Aniruddha Bose sought the presence of a responsible Central Bureau of Investigation (CBI) officer to apprise it of all details on the Unnao rape case.

The Unnao rape case took a controversial turn after a lorry without a number plate rammed into the car in which the victim was travelling. The victim and her lawyer have been critically injured, while two of her aunts passed away.

Foul play on the part of BJP MLA Kuldeep Sengar – the accused in the rape case – has been alleged by the mother of the victim.

Sengar has been in prison since last year. The Allahabad High Court had, in April last year, ordered the arrest of Sengar for raping a 15-year-old girl in 2017. The Court had also directed that the investigation of the case be handed over to the CBI.

CJI Gogoi hinted this  morning that the trial of the Unnao case may be transferred to Delhi from Uttar Pradesh. During the afternoon hearing, The Court passed an order to this effect. Further, the  Court has also directed protection be given to the victim and her family, as well as the lawyer and his family.

Live updates of the hearing follow:

  • Solicitor General Tushar Mehta tells Court that CBI is seized of four cases.
  • Case 1 – Rape of victim. Status: Chargesheet filed, accused are in jail. Case 2 – An offence against father of the victim under Arms act which was found to be a false case.
  • Case 3: After father of victim died in police custody, mother of victim filed a complaint. Chargesheet has been filed in this.
  • Case 4: Gang rape of victim one week after she was raped by Kuldip Singh Sengar.
  • Supreme Court asks Solicitor General about the condition of the victim. SG tells court that she is on ventilator. Court asks SG to explore the possibility of airlifting victim and shifting her to a hospital in Delhi.
  • Supreme Court asks CBI to complete probe into the accident case in seven days.
  • Amicus Curiae V Giri says incident extremely disturbing. Some exemplary compensation should be given. Bench rises, will re-assemble at 2 pm to pass orders on airlifting of victim, transfer case to Delhi and completion of probe.
  • Meanwhile Supreme Court registry informed CJI that the delay in dealing with the letter written by Victim and family to CJI was not deliberate. Registry receives more than 5,000 letter petitions a month. Last month it received 6,800 letter petitions, Secretary General tells SC.
  • Letter petitions are screened as per Supreme Court judgment. Registry was in the process of screening when it came to know from reports that victim had written to CJI Immediately, the letter was traced and placed before CJI. The delay was not deliberate, Secretary General to SC.
