The Delhi High Court recently closed contempt of court proceedings against an advocate who had alleged that a prosecutor was controlling a Delhi judge.

The Division Bench of Justice Vivek Chaudhary and Justice Manoj Jain chose to close the case after the advocate tendered an unconditional apology.

“During the course of the hearing today, as noted already, he has tendered oral apology. Having heard him and keeping in mind the overall facts, his unconditional apology is, hereby, accepted and, resultantly, the contempt proceedings are directed to be closed,” the Court stated. 

The case arose after the lawyer had insinuated before a Delhi court that the prosecutor wields control on the court and not the presiding judge.

The Additional Sessions Judge made a reference to the High Court for initiating contempt of court proceedings against the lawyer under the Contempt of Courts Act.

Upon receiving the contempt reference, the High Court issued notice to the contemnor. Thereafter, he physically appeared before the High Court and tendered an unconditional apology.

He stated that in his practice of twelve years, he had never disrespected the court. He further said that his law practice is the only source of livelihood for him and his whole family.

The Court accepted his apology and closed the case.
