The Supreme Court Collegium has resolved to remit one name each recommended for elevation to the Delhi High Court and the Karnataka High Court.
As regards the Delhi High Court, the Collegium decided to send back the recommendation to elevate Advocate Krishnendu Dutta to the Delhi High Court Collegium.
The three seniormost judges of the Supreme Court also deferred the recommendation to appoint Advocate Saurabh Kirpal as a judge. The resolution states,
“On the basis of material on record and having regard to all relevant factors, the Collegium is of the considered view that the proposal for elevation of Shri Krishnendu Datta, Advocate, deserves to be remitted to the Delhi High Court…
…The proposal for elevation of Shri Saurabh Kirpal, Advocate is deferred.”
The names of Dutta and Kirpal were one of the nine names recommended by the Delhi High Court on October 13, 2017. The consideration to elevate these two names was deferred twice by the Supreme Court Collegium – once on September 4, 2018, and for the second time on January 16, 2019.
For the Karnataka High Court, the Collegium decided to remit the name of Judicial Officer Shashikala Moody Anandappa Urankar, who was recommended for elevation to the High Court on July 30, 2018. The resolution states,
“On the basis of material on record and having regard to all relevant factors, the Collegium is of the considered view that the proposal for elevation of Dr. (Smt.) Shashikala Moody Anandappa Urankar, Judicial Officer, deserves to be remitted to the Karnataka High Court.”
