Shiv Sena (Uddhav) leader moves Bombay High Court against election of Shinde faction's Ravindra Waikar

Waikar was elected as a Member of Parliament (MP) from the Mumbai North West Lok Sabha constituency after beating Amol Kirtikar by 48 votes.

Amol Kirtikar of Shiv Sena Uddhav Thackeray faction has moved the Bombay High Court against the election of Ravindra Waikar of the Eknath Shinde led Shiv Sena from Mumbai North West Lok Sabha constituency in the recently concluded general elections [Amol Gajanan Kirtikar v Ravindra Dattaram Waikar & Ors.[]

Waikar was elected as a Member of Parliament (MP) after beating Kirtikar by 48 votes.

The plea filed through advocate Amit A Karande has contended that Waikar's election is void due to the results being materially affected by the improper reception of votes, leading to 333 uncounted tendered votes.

Additionally, the plea has alleged a complete breach of statutory rules and orders by the Returning Officer (RO) during the counting process:

  • Counting agents appointed by Kirtikar were not allowed to sit at the RO tables despite having a statutory right;

  • Form 17-C (Part II) (results of counting) was not provided in 839 polling booths;

  • Kirtikar's application for a recount of votes was hastily rejected;

  • Unauthorized use of mobile phones occurred in the counting area;

  • There was impersonation of electors;

  • Discrepancies were noted in the number of tendered votes recorded.

Accordingly, the petition has prayed for setting aside of Waikar's election and to declare Kirtikar as the winning candidate.
