Location: UP RERA Headquarters, Lucknow/ Regional Office, Greater Noida

Qualification: LLB. Enrolled with the Bar Council

Scope of work

The Legal Consultant shall be required to

Support in Court cases

  • Assist authorities in preparation and sending instructions to advocates.

  • Draft and file counter affidavits, supplementary affidacitys, draft and file appeals, second appeals, writ petitions, SLPs, replies and responses, as required before the RERA Appellate Tribunal, the High Court, the Supreme Court and other forums.

  • Coordinate with standing counsels, senior counsels, senior advocates, advocates-on-record engaged by the Authority from time-to-time and quickly update concerned officers of the Authority, assist in drafting and sending desired inputs and briefing them.

  • Track cases, maintain case records and ensure timely submission of responses.

  • Immediately bring to the notice of the concerned officers the interim or final orders of the higher courts with appropriate strategy for compliance and follow up or contesting the same.

  • Assist the Authority in sending reports and replies to the Government in matters of legal significant and sending legal notices to the promoters and agents.

Legal Research and analysis

  • Conduct in-depth research on real estate laws, regulatory and other relevant statutes, consumer matters, case precedents and constitutional issues, with focus on but not limited to the appropriate rulings of the Supreme Court, theHigh Courts, the NCLAT, the NCLT, RERA Appellate Tribunals, etc.

  • Prepare legal briefs and concept notes on emerging legal issues within the domain pertaining to the real estate regulatory authorities.

Drafting and vetting of Orders / Regulations

  • Draft legally sound and well-reasoned notices and orders in the matters relating to the affairs of the Authority.

  • Draft notices, draft or vet, as the case may be, orders, circulars, regulations, guidelines, and internal instructions for legal compliances.

Advisory support

  • Provide sound legal opinions and suggest appropriate approach on issues arising in the functioning of the Authority.

  • Suggest strategies for strengthening legal compliances and minimizinglitigation risks.

The Legal Consultant will report to the Legal Advisor, UP RERA and work in supervision of the Secretary subject to the overall direction and control of the UP RERA Chairman.

Qualification and experience

  • Bachelor’s degree in law (LLB) from a reputed university; five-year degree will be preferred.

  • Minimum 5 years’ professional experience in case related work pertaining to the higher courts, legal research and drafting, preferably with reputed law firms.

  • Demonstrated experience in handling matters before the higher courts including, but not limited to the High Courts and the Supreme Court of India.

  • Strong legal drafting and research skills and computer proficiency, with knowledge of real estate, consumer protection, regulatory, contractual and constitutional law.

  • Proficiency of written and verbal communication in English and Hindi.

  • Ability to work under strict deadlines.

Selection process

  1. An Expression of Interest will be asked for on the web-portal of UP RERA under CAREER section.

  2. On the basis of EOIs received, a short list of eligible applicants will be prepared by U.P. RERA.

  3. The shortlisted applicants will be required to go through the following process for selection of suitable applicant:

    i) Relevant professional experience (30%): Assessment of the applicant’s previous work with law firms, regulatory bodies, government authorities and experience of handling matters of litigation before the higher courts.

    ii) Legal drafting and research skills (40%): Applicants shall be required to complete a written assignment administered by the Authority on the day of the interview, to evaluate the quality of legal drafting, analytical ability and research skills.

    iii) Interview performance (30%): The interview shall assess communication skills, domain knowledge in real estate and regulatory

    laws, analytical thinking, and the ability to present and defend legal

    arguments effectively.

  4. The shortlisted applicants will be required to submit their salary slips (indicating the gross and net amount) issued by the last organization they are/ were working with. They will be required to submit the salary slip immediately after they are informed about being shortlisted.

  5. A Committee shall be constituted by Chairman, UP RERA for reviewing the performance of the candidates in the selection process as given above in sub-point no. 3. The final decision on the selection of the suitable candidate on the basis of the recommendations of the above Committee shall be made with the approval of the Chairman, UP RERA who reserves the right to reject all applications at any stage prior to his final approval without assigning any reasons therefor.

Remuneration

Remuneration will be commensurate with experience, qualifications and the last salary drawn vis-a-vis UP RERA’s approved norms and benchmark for engagement of the said consultant on the basis of negotiation. There will be yearly increase of 5 percent in the remuneration.

Duration and Tenure

The engagement will be on a full-time contractual basis for an initial period of two (2) years, however, the Authority shall review the performance of the legal consultant on annual basis.

The selected candidate shall have to execute a contract with the Authority and the contract and the tenure will commence from the date of joining in the office of the Authority which can not be later than the 15 th day from the date of signing of the contract. The Chairman can relax the period of joining subject to his satisfaction on a written request of the selected candidate giving out justification for the same.

The contract is extendable with the approval of the Chairman, UP RERA based on outstanding performance, institutional needs, and mutual consent, but not for more than one year at a time subject to a maximum period of three years beyond the original contract period of two years.

Termination of the Contract

The parties can terminate the contract any time with a prior written notice of one month or by payment of an amount equal to one month remuneration. The Authority can terminate the contract any time with the approval of the Chairman, UP RERA without assigning reasons for the same by paying one month’s advance remuneration to the consultant.
