SUMMARY OF CASES

1. Balwant Singh Khera v Election Commission of India & Ors.

[Item 5, Court 3- W.P.(C) 1218/2010]

Bench- Pradeep Nandrajog, Mukta Gupta JJ.

Petition seeking a direction to the EC to set aside the registration of Shiromani Akali Dal (SAD) under Section 29A of RPA.

On the last date of hearing, both sides argued on the merits of the case and the relevance of Section 29A of the RP Act. The court had framed a number of issues for further examination, including:

  • Whether the decision to register a political party by the EC is a ‘legislative’ or ‘quasi-judicial’ decision. This would be necessary to take a view as to whether the courts should interfere or not.
  • If there is a wrong without a remedy, that is, if such a fraud has indeed been committed and if there is no provision in law to cancel the registration of a political party, can the courts step in to fill that void in the law?

Today in Court- Digital Radio (Red FM) told the Bench today that they had signed the Grant of Permission Agreement (GOPA) with the Govt today which would enable them to migrate into Phase III in three radio channels they had won in an auction held last year.

After seeking directions to the Centre to sign GOPA for the three channels at Mumbai, Srinagar and Jodhpur, the company agreed to withdraw its plea.

4. Government of National Capital Territory of Delhi v Union of India, Rajendra Prashad v Govt of NCT of Delhi, MA Usmani v Union of India & Ors, Naresh Kumar v Govt of NCT of Delhi & Ors.

A batch of petitions questioning the apportionment of powers between the Chief Minister and Lt-Governor.

Today in Court- The Bench reserved its orders on a stay application moved by the Delhi Government seeking stay on proceedings on the ground that the issues involve a dispute of “federal nature” between the Centre and Delhi government and the Supreme Court has exclusive jurisdiction to deal with the matter. The AAP-led Delhi Government has already moved a suit in the Supreme Court in this regard.

5. HT Media Ltd v Government of NCT of Delhi & Ors.
