When Justice AM Khanwilkar began to read out the judgment in the Bhima Koregaon case today, many who were present in court were in for a surprise..The causelist for today reflected only one judgment which was to be pronounced by Justice DY Chandrachud..Justice Khanwilkar, however, pronounced the judgment turning down the petition. It was still unclear whether he was pronouncing for the majority..Things however attained clarity when Justice Chandrachud, before starting his pronouncement said that Justice Khanwilkar has pronounced for the majority and that he himself had dissented..Interestingly, the Supreme Court website had already published a notice clarifying the same today morning..The causelist, thus seemed to have omitted the name of Justice AM Khanwilkar, who as it turned out, pronounced the majority judgment on behalf of himself and Chief Justice of India Dipak Misra..What is interesting is that this is happening for the second time in two days. A very similar omission happened yesterday – in the Ram Mandir-Babri case..The story was slightly different though. In that case, it was the name of the dissenting judge, Justice S Abdul Nazeer, which was not reflecting in the causelist..However, minutes before the pronouncement of the verdict at 2 pm yesterday, a notice appeared outside the court of Chief Justice of India intimating that a separate judgment would be pronounced by Justice Nazeer.
