The Chief Minister and Governor of Bihar subsequently concurred with the proposal.Following the same, judges of the Supreme Court conversant with the affairs of the Patna High Court were consulted, and the inputs of the Union Department of Justice (DoJ) were also sought to assess their merit and suitability..For Mishra, the Collegium noted that he was the senior-most judicial officer in the concerned cadre and met all criteria.For Malviya, the Collegium noted that he would have a favourable duration of tenure as a High Court judge if appointed. His service record showed that he had been rated as a 'very-good' officer even though the DoJ stated that his professional competence was average.On this the Collegium said,"An observation made in the file that his professional competence is average should not come in the way of his recommendation inasmuch as it is for the judiciary to assess judicial performance of a judicial officer."It, thus, found Malviya suitable for appointment as a judge of the Patna High Court.
