[Article 226] Court can grant relief to which party is entitled even if not specifically sought for: Kerala High Court

"Merely for the reason that a specific relief has not been sought, it is not an impediment for the court exercising power under Article 226 to grant a relief which a party is entitled to," the Court said.

The Kerala High Court on Wednesday observed that there is no fetter on the Court exercising its power under Article 226 of the Constitution to grant a relief that a party is entitled to, even if the specific relief hadn't been sought for in the petition [Smitha MG v State of Kerala].
