Delhi HC allows Priya Kapur to file Sunjay Kapur's assets in sealed cover; parties agree not to make press statements

The Delhi High Court on Thursday allowed Priya Sachdev Kapur to file the list of assets of her late husband Sunjay Kapur in a sealed cover in the case between her and Sunjay Kapoor's children from his first marriage with actress Karisma Kapur.

Justice Jyoti Singh also recorded the undertaking from the lawyers appearing on all sides that they will not discuss the case in the media.

"Mr Rajiv Nayar [counsel for Priya Kapur] submits that neither he nor any other lawyer on his side nor his clients will give any press statement concerning this case. A similar assurance is given by Mr Mahesh Jethmalani [counsel for Karisma Kapoor's children], as also Defendant Number 3 [Sunjay Kapur's mother Rani Kapur]," the Court recorded in its order.

Further, the Court said that the copy of Sunjay Kapur's will, which has been filed in the sealed cover, should be given to his mother Rani Kapur.

The Court passed the order on an application filed by Priya Kapur in an already pending suit filed by Sunjay and Karisma Kapur's children seeking a share in their father's assets. 

While hearing a partition suit, the High Court had on September 10 ordered Priya Kapur to submit a list of all movable and immovable assets of Sunjay Kapur after the children claimed that the will in question was forged by Priya Kapur to usurp their father's assets.

Background

Karisma Kapoor and Sunjay Kapur were married for 13 years, between 2003 and 2016 before getting divorced. They have a son and a daughter together. Their children have accused stepmother Priya Kapur (Sunjay's third and last wife) of forging his will and trying to gain total control of the assets. 

The children, represented through their mother, moved the Court arguing that they have been wrongfully excluded from Kapur’s estate by Priya Kapur following his sudden death in June this year while in the United Kingdom.

Central to the dispute is a will dated March 21, 2025, which allegedly leaves Sunjay Kapur’s entire personal estate to Priya Sachdeva Kapur.

Priya Kapur has denied the allegations and her lawyers have argued that there is enough evidence to show the will in question was created and executed much before Sunjay Kapur's death.

Kapur's lawyers have also disclosed that assets worth around ₹1,900 crore have been transferred to the plaintiff siblings and that Karisma Kapoor and Sunjay Kapur’s marriage culminated in a bitter divorce after which she was “nowhere to be seen”.

Senior Advocate Mahesh Jethmalani with advocates Saurav Aggarwal, Ravi Sharma, Shantanu Aggarwal, Akhil Sachar, Madhulika Rai Sharma and Manas Arora appeared for Karisma Kapoor's children (plaintiff).

Senior Advocate Vaibhav Gaggar represented Rani Kapur.
