Dying declaration discarded to acquit a person cannot be basis for convicting co-accused: Supreme Court

The Court found that the dying declaration of a woman was relied upon only to convict her husband whereas it was disbelieved when it came to examining the allegations made against the father-in-law.

A dying declaration which was discarded by court leading to the acquittal of an accused cannot be made the basis for conviction of another accused in the same matter, the Supreme Court said on Wednesday [Phulel Singh vs State of Haryana].
