Hyderabad court grants ad interim injunction in favour of Ola

The Hyderabad City Civil Court has granted an ex-parte ad interim injunction in favour of ANI Technologies Private Limited (Ola).

The suit was instituted by ANI Technologies, which was represented by L&L Partners, against a firm that that was allegedly using the ‘Ola’ trademark on car batteries.

L&L Partner Faisal Sherwani and Managing Associate Shikher Deep Aggarwal, appeared on behalf of ANI Technologies.

It was argued that this was a clear case of passing off, since the word ‘Ola’ had become synonymous with the plaintiff company and its operations.

The Additional Chief Judge III held that a prima facie case of passing off was made out. The court ultimately passed an interim order restraining the respondents from making any direct or indirect use of ANI’s mark.

The matter will next be heard on September 19.
