The Supreme Court on Monday upheld the anticipatory bail granted by the Andhra Pradesh High Court to former Chief Minister (CM) Nara Chandrababu Naidu in connection with the Inner Ring Road scam [State of Andhra Pradesh vs Nara Chandrababu Naidu]..A bench of Justices Sanjiv Khanna and Dipankar Datta refused to entertain the Andhra Pradesh government's appeal in this regard after noting that co-accused had been granted pre-arrest bail in the matter.It added that the orders would not come in the way of further investigation in the matter and the State can move for cancellation of bail if Naidu does not cooperate with the probe. "We clarify that the observations made in the impugned order would not affect the investigation and the Investigating Agency would be free to investigate, uninfluenced by the observations made in the order of the High Court. We further clarify that in the event the respondents do not cooperate with the Investigating Agency, the petitioner would be at liberty to move for cancellation of bail before the courts below," the top court observed..Naidu is accused of engaging in corrupt practices during the development of the master plan for the State's capital city of Amravati including the alignment of the inner ring road.These actions were allegedly intended to favour specific individuals and entities linked to him.The former CM had earlier filed a regular bail plea contending that he is considered to be in custody from the time of his arrest in the skill development scam case.The same was rejected by the High Court on Ocotber 9 last year. The High Court had dismissed the contention that there was deliberate negligence on the part of the police in taking steps to arrest him though the case was registered in 2022.It had, however, in effect granted liberty to file an anticipatory bail plea.
