Karisma Kapoor says her daughter's fees haven't been paid for 2 months; Delhi HC tells parties to avoid melodrama

The Delhi High Court on Friday remarked that it does not want the proceedings in the case filed by actor Karisma Kapoor’s children against their stepmother Priya Sachdev Kapur for a share in their late father Sunjay Kapur’s estate to be “melodramatic”.

“I don’t want this hearing to be melodramatic,” Justice Jyoti Singh remarked.

The judge made the remark after Senior Advocate Mahesh Jethmalani, appearing for Karisma Kapoor’s children, alleged that the actress' daughter is studying in a US university and her fees have not been paid for two months. 

Jethmalani said that as part of the matrimonial decree, Sunjay Kapur was to pay for the children’s studies and expenses. 

“The children’s estate is with Defendant No.1 [Priya Kapur]. So, it’s up to her. Two months’ fee of the daughter who is studying in the US has not been provided,” Jethmalani stated.

Senior Advocate Rajiv Nayar, appearing for Priya Kapur, challenged that assertion and stressed that all the expenses raised by the children have been taken care of by Priya Kapur. 

He said that the only object behind raising the issues in the Court was to get the same reported in the media. 

“The purpose is that the same should come in the newspaper,” he said. 

Justice Singh said that such issues should not come to Court. She then asked Senior Advocate Shyel Trehan, also representing Priya Kapur, to ensure issues like these are taken care of.

“I don't want to spend more than 30 seconds on this. This question should not come to my court again. I don't want this hearing to be melodramatic. I put this onus on you [Shyel Trehan]. This point should not come again,” the Court said. 

The High Court was hearing the arguments on the interim injunction application filed by Karisma Kapoor’s two children to restrain Priya Kapur from alienating Sunjay Kapur’s assets. 

In the main suit, the siblings have accused stepmother Priya Kapur (the third wife of Sunjay Kapur) of forging Sunjay Kapur's will and trying to gain total control of the property. 

Karisma Kapoor and Sunjay Kapur were married for 13 years, between 2003 and 2016, before getting divorced. They have a son and a daughter together. Sunjay later married Priya. 

Central to the dispute is a will dated March 21, 2025, which allegedly leaves Sunjay Kapur’s entire personal estate to Priya Sachdeva Kapur.

Today, Nayar continued with his submission in opposition to the interim injunction application. He stressed that the will was authentic and that the same was shared in the family WhatsApp group as well. 

“Execution and attestation of the Will is proved by the two witnesses, and until trial they have to be treated as valid,” he said. 

The Court said it will continue hearing the case on November 19. It added that it wants to finish the arguments on the interim injunction application expeditiously.
