2018 Supreme Court verdict quashing Section 497 IPC on adultery will apply to pending proceedings even for offences prior to 2018: Jharkhand HC

There is no indication that the same would apply prospectively and there is nothing like any prospective operation of law laid down by Supreme Court, the High Court said.

The Jharkhand High Court has held that the 2018 judgment of Supreme Court quashing criminal offence of adultery under Section 497 of Indian Penal Code (IPC) is applicable to all pending proceedings even with respect to offences committed before the provision was struck down (August Kumar Mehta vs. State of Jharkhand).
