Delhi HC orders Veer Ji Malai Chaap to take down videos falsely showing Zippy's facility as its own

The restaurant chain is accused of falsely portraying a third-party manufacturing facility and its production processes as its own in promotional videos and website content.

The Delhi High Court recently directed restaurant chain Veer Ji Malai Chaap to remove videos that allegedly misrepresented a food manufacturing facility owned by Zippy Edible Products Private Limited as its own [Zippy Edible Products Pvt. Ltd. v Veerji Restaurant Pvt. Ltd. & Ors.].

Justice Jyoti Singh on May 29, sought responses of the restaurant and it's stakeholders.

The counsel for Veer Ji Malai Chaap submitted that the videos flagged had already been taken down. However, Zippy disputed this, contending that two videos continued to remain online.

Recording these contentions, the Court observed,

"Statement of learned counsel made on behalf of Defendants No. 1 to 5 that impugned videos have been taken down is taken on record and accepted. It is, however, directed that in case any impugned video has not been taken down, necessary action will be taken within 24 hours from today to take them down.

The Court further directed that if Veer Ji Malai Chaap failed to remove any remaining videos, Zippy could notify Meta (YouTube), following which the social media platform would be required to act within a period of 4 weeks.

"In case Defendants No. 1 to 5 (restaurant and stakeholders) do not take down the impugned videos, intimation to this effect will be given by the Plaintiff to... Meta Platform Inc. and on receipt of information... (Meta) shall take down the videos within 36 hours from the time of receipt of the intimation. Compliance affidavit be filed by Defendants No. 1 to 5 and/or... (Meta) as the case may be within four weeks from today," the Court ordered.

The order came on a commercial suit filed by Zippy accusing the restaurant chain of falsely portraying its Rudrapur manufacturing facility, machinery and production processes as belonging to Veer Ji Malai Chaap through a promotional YouTube video and related online content.

Zippy alleged that the restaurant chain indulged in passing off, misrepresentation, unfair competition, dilution, disparagement and unlawful disclosure of confidential information and trade secrets.

According to Zippy, Veer Ji Malai Chaap had been sourcing products from it during 2025. It had then been granted limited permission to film inside Zippy's Rudrapur factory for promotional purposes, subject to certain conditions.

The petition alleged that the promotional video, featuring the restaurant chain's brand ambassador Vindu Dara Singh, falsely attributed the ownership of the manufacturing facility to Veer Ji Malai Chaap.

Zippy further claimed that Veer Ji Malai Chaap stopped sourcing products from it in November 2025 but continued to market its own products as if they were manufactured at Zippy's facility. The petition argued that the restaurant chain was misleading consumers and benefiting from Zippy's reputation.

Besides alleging passing off and misrepresentation, Zippy also accused Veer Ji Malai Chaap of disclosing confidential information and trade secrets by filming its production line and patented manufacturing processes without authorisation.

The petition also contended that the content could damage its reputation by creating the impression that Veer Ji Malai Chaap's current products continue to originate from Zippy's facility.

Advocates Manmeet Kaur Sareen, Arpit Singh Arora, Tanmay Mehta and Rashmi Gogoi represented Zippy Edible Food Products.

Advocates Nihit Nagpal, Vaibhav Mehra and Shuchita Chaubey appeared for the restaurant and its stakeholders.

Advocates Amee Rana, Akhil Shandilya and Bhavnish Kaur represented Meta Platforms Inc.
