[Jantar Mantar hate speech] "All kinds of slogans given:" Delhi High Court refuses interim protection to Pinky Chaudhary for now

The Delhi High Court on Friday refused to grant any interim protection to Pinky Chaudhary, one of the accused in case registered over anti-Muslim sloganeering at Jantar Mantar. (Bhupinder Tomer alias Pinki Chaudhary v. The State of NCT of Delhi).The Court, however, issued notice to the Delhi government on Chaudhary's plea for anticipatory bail and posted the matter for further consideration on September 13.."I have issued notice, I will find it out. You cant just insist. There is all kinds of slogans and speeches being given," Justice Mukta Gupta said when Chaudhary's counsel insisted for interim protection from arrest.On August 21, a Delhi Court had dismissed an anticipatory bail plea moved by Chaudhary in the case.Advocate Vishnu Shankar Jain appearing for Chaudhary, asserted that Chaudhary was not involved in the slogan chanting which is the focus of the FIR. "At the outset, my client has not raised any slogans. The organiser, Ashwini Upadhyay has already been granted bail ... My client was not there in slogan chanting. There is an interview they are relying on to say because of interview Section 153A is attracted. The FIR is for slogan chanting. I am not there in slogan chanting," he argued. ."I really want to know where you were (at the time slogans were raised). You were not present at all?", asked Justice Mukta Gupta.."I was present, but not involved in slogan chanting. Lordship may kindly direct my friend to hold their hands till hearing," Jain urged. .He also highlighted that he was earlier granted interim protection by a Delhi Court. On the Court's queries, he affirmed that the anticipatory bail plea before the Delhi Court was later dismissed. .The High Court went on to decline to grant interim protection and instead posted the matter for further hearing on September 13, when the government is expected to file a status report. .The Court orally observed that the FIR is only a preliminary document and that further investigation may be carried out later..Additional Public Prosecutor Tarang Srivastava, for the State NCT of Delhi, informed the Court that there are certain transcripts and videos which have been sent to the Court in the matter. These include a transcript containing the slogans and another transcript that shows the participation of Chaudhary in the event.
