Occasional acts of adultery committed in isolation do not disentitle woman from maintenance: Delhi High Court

The Court held that only continuous and repeated acts of adultery and/ or cohabitation in adultery would attract the rigours of the provision under Section 125 (4) of the CrPC.

The Delhi High Court has held that one or occasional acts of adultery committed in isolation does not amount to “living in adultery” and, therefore, does not disentitle a woman from maintenance after divorce [Sh Pradeep Kumar Sharma v Smt Deepika Sharma].
