The Supreme Court on Tuesday granted bail to one Kara Ratheesh, an accused in an attempt to murder case and a member of right wing organisation All India Hindu Parishad..A Bench of Justices Navin Sinha and Ajay Rastogi set aside a March 18, 2021 order of the Kerala High Court which had cancelled the bail granted to Ratheesh in March, 2018. .Ratheesh had recently been in limelight after he was involved in the destruction of a church-like movie set in May 2020..The present case started in March 2014 when Ratheesh attempted to kill one Rithin Rajan.He was convicted under Section 307 (attempt to murder) and Section 324 (voluntary hurt using dangerous weapons) of India Penal Code by the Additional Sessions Judge, Paravur on October 31, 2017 and sentenced to 10 years imprisonment.The Kerala High Court on appeal suspended the sentence while granting bail to the petitioner in March 2018..[Attempt to Murder case] Supreme Court seeks Kerala govt response in plea by All India Hindu Parishad member challenging cancellation of bail.One of conditions for grant of bail was that he would not be involved in any criminal activities.But the destruction of the movie set and another incident involving obstruction to traffic led to two FIRs registered against him.The State and Rajan then preferred applications for cancellation of bail before the Kerala High Court which was allowed.Ratheesh then moved the Supreme Court in appeal. .Ratheesh contended that the bail granted to him on March 21, 2018 was erroneously cancelled by the High Court on March 18 ,2021 “on absolutely flimsy grounds.”Senior Advocate R Basant and advocate Raghenth Basant, appearing for Ratheesh, told the Court that the two FIRs registered against Ratheesh were filed after he was released on bail in 2018 and there was nothing to show that he individually committed any of those crimes so as to forfeit the indulgence granted by the Court.."On going through the two FIRs, we find they were more in the nature of public protests like stopping shooting a film in a temple etc. We are unable to sustain order of High Court. Petitioner was on bail for nearly three years. Impugned order is therefore set aside," the top court ordered. .During the previous hearing, the apex court had asked Ratheesh to surrender before the Police after the Bench was informed that he was absconding. Ratheesh had then presented himself before the Angamaly Police station.
