Rohatgi’s appointment as AG cleared while Gopal Subramanium’s elevation to the Bench uncertain

Putting an end to much speculation, the government has cleared the appointment of Senior Advocate Mukul Rohatgi as the new Attorney General for the country. As per a report in the Times of India, the official notification shall be released at the end of this week, after Law Minister Ravi Shankar Prasad approve the appointment today.

This appointment comes a few days after it was revealed that the former Law Minister and Senior Advocate, Ram Jethmalani had voiced his objections to the appointment.

Even as Rohatgi’s appointment has been cleared, another one remains uncertain.

A few weeks after Chief Justice RM Lodha had recommended the elevation of former Solicitor General, Gopal Subramanium, to the Supreme Court Bench, the Law Ministry is reconsidering this decision. According to a report in the Economic Times, the Law Ministry is yet to grant approval of the elevation, with the matter being “discussed at the highest levels”. This could be a reference to the Prime Minister’s Office, and the fact that all such appointments are to have the PMO’s approval.
