The Supreme Court Collegium has reiterated its recommendation for the appointment of Advocate Amit Negi, as a judge of the Allahabad High Court.
However, the proposal to appoint Advocates Basharat Ali Khan and Mohd. Mansoor has been sent back to the Chief Justice of Allahabad High Court.
The proposal for the elevation of Amit Negi was made by the High Court Collegium on April 11, 2016. It was then cleared by the Supreme Court Collegium twice, on August 30, 2016 and November 15, 2016.
In June 2017, the recommendation was withheld after inputs on an FIR against him came to the Collegium’s notice.
This FIR was, however, quashed by the High Court and no appeal was preferred against it by the State of Uttar Pradesh. Subsequently, the Collegium, on August 1, decided that the proposal for the elevation of Amit Negi “needs to be processed further most expeditiously“.
The names of Basharat Ali Khan and Mohd. Mansoor’s were cleared by the Supreme Court Collegium for elevation to Allahabad High Court twice, on February 4, 2016 and April 4, 2016.
The decision was, however, deferred by the Collegium on November 15, 2016, after the Department of Justice observed that it was awaiting “inputs” on a complaint containing allegations against them.
After perusal of these “fresh inputs” and other material, the Collegium has now chosen to remit the proposal to the Chief Justice of the Allahabad High Court.
