Former Delhi Chief Minister Arvind Kejriwal has filed an application in the Delhi High Court requesting Justice Swarana Kanta Sharma to recuse from hearing the appeal filed by the Central Bureau of Investigation (CBI) discharging him and others in the Excise policy case.

The application has been filed in CBI's appeal and is likely to come up for consideration before Justice Sharma tomorrow.

According to lawyers familiar with the case, Kejriwal is also likely to appear before the Court tomorrow and make submissions in person.

Notably, Kejriwal had earlier requested that the Delhi High Court Chief Justice Devendra Kumar Upadhyaya assign the case to a judge other than Justice Sharma.

However, Chief Justice Upadhyaya rejected the request.

"The petition is assigned to the Hon'ble judge as per the current roster. Any call of recusal has to be taken by the Hon'ble judge. I, however, do not find any reason to transfer the petition by passing an order on the administrative side," the Chief Justice had said.
