Delhi High Court awards ₹20 lakh costs to Louis Vuitton in trademark infringement suit against Club Factory

The Delhi High Court recently awarded costs of ₹20 lakh in favour of international luxury brand Louis Vuitton (LV) in its trademark suit filed against China-based retailer Club Factory. (Louis Vuitton Malletier v. Futuretimes Technology India Pvt Ltd)

Appearing for Louis Vuitton, Advocate Pravin Anand told the Court that the company only wished to press for costs in the matter, and not for the damages previously sought.

Justice Prathiba M Singh awarded ₹20 lakh costs in favour of the fashion brand, though the bill of costs placed on record showed a total claim of over ₹32 lakh.

On March 24, 2020, the suit was decreed in favour of LV and Club Facotry was permanently restrained from selling, advertising, or offering for sale any products with the registered LV mark on its portal.

Moreover, the Court had directed the Department of Telecommunications (DoT) and the Ministry of Electronic and Information Technology (MeiTY) to block the Club Factory website so that the same is not accessible.

Interestingly, the Club Factory app was one of the 59 Chinese apps banned by the Indian government in 2020 on the basis of national security concerns.

Along with Pravin Anand, Advocates Dhruv Anand, Udita Patro and Nimrat Singh represented Louis Vuitton.
