The Delhi High Court on Wednesday issued notice to Rani Kapur, mother of late businessman Sunjay Kapur, on an application filed by Priya Kapur alleging that she committed perjury.
Justice Mini Pushkarna said that the case will be heard on March 23.
"Issue notice. Notice is accepted by the counsel for non-applicants," the Court recorded in its order.
Senior Advocate Akhil Sibal appeared for Priya Kapur and argued that many of the allegations made in Rani Kapur's suit are "utterly false".
Senior Advocate Maninder Singh, also appearing for Priya Kapur, stated that perjury is an offence and fraud against the court, and that Rani Kapur lied under oath.
The application was opposed by Rani Kapur's counsel, Advocate Smriti Churiwal. She questioned the application's maintainability. One of Rani Kapur's grandchildren (Mandhira Kapur's daughter) supported Churiwal's opposition.
Priya Kapur has moved the perjury application in Rani Kapur's pending suit to declare the family trust illegal.
In her suit, 80-year-old Rani Kapur said that the trust was constituted fraudulently and has been used to divest her of her entire estate, including control over the Sona Group of companies. She alleged that Priya Kapur, Sunjay Kapur’s widow, is the “chief mastermind” of the conspiracy.
She also accused Priya Kapur of acting swiftly after Sunjay Kapur’s death to assume control of key Sona Group companies without notice to her.
Notably, while hearing the case on February 10, the High Court remarked that the entire dispute over Sunjay Kapur's estate reflected a sorry state of affairs and that the family must try to resolve the case through mediation.
