The Bombay High Court has directed Amazon Seller Services to delist all Victorinox-branded products being sold by Gute Reise India Pvt. Ltd. after Victorinox - which manufactures Swiss Army knives - pointed out that Gute Reise was no longer authorised to sell such products [Victorinox India Private Limited v Gute Reise India Private Limited & Anr].
Justice Somasekhar Sundaresan, in an interim order dated July 11, stated,
“Amazon Seller Services Private Limited shall immediately take down and delist all listings of Victorinox branded products being offered for sale by Gute Reise India Private Limited (under seller name ‘Gava Retail’) pending conduct of the arbitration proceedings.”
Victorinox India Pvt Ltd, the Indian arm of the Swiss manufacturer best known for its Swiss Army knives, had filed an urgent petition claiming that despite a July 9, 2025 order by the arbitral tribunal prohibiting Gute Reise from selling Victorinox products, such goods continued to be listed on Amazon.
Gute Reise was previously an authorized dealer of Victorinox's products.
The Court noted that Gute Reise had placed on record emails sent to Amazon in compliance with the arbitral tribunal’s order, instructing the e-commerce platform to refrain from listing Victorinox goods linked to its (Gute Reise's) account and to act against stock already at fulfillment centers.
Despite this, Victorinox’s counsel argued that the products remained available online, especially ahead of Amazon’s Prime Day Sale, which is scheduled to begin today (July 12).
Taking note of Gute Reise’s apparent efforts to comply but also the urgency presented by the ongoing sale, the Court granted Victorinox’s request for interim relief. It has instructed Amazon to take down the disputed listings. It also clarified that Gute Reise could continue using its Amazon account to sell non-Victorinox products.
The matter has been posted for further hearing on July 30, 2025.
Advocate Samudra Sarangi, along with advocates Joran Diwan and Riya Kalra, instructed by Diwan Law Associates and Law Offices of Panag & Babu appeared for Victorinox India Private Limited.
