Bollywood actress Shilpa Shetty has moved the Bombay High Court to restrain publication of incorrect, false, malicious, and defamatory information against her on social media and websites in connection with the arrest of her husband Raj Kundra in porn film racket case (Shilpa Shetty Kundra vs. Clapping Hands Pvt. Ltd.)

The New Indian Express, India TV, Free Press Journal, NDTV, Facebook, Instagram, and Facebook, among others have been made parties to the defamation suit by Shetty.

The plea also sought interim injunctions against the defendants.

The application was filed after Kundra's bail plea in the porn film racket case was rejected on July 28 by a Mumbai court.

Shetty submitted that the defendants are smearing her reputation with the aim of sensationalizing news and increasing their readership and viewership

In this regard, it was stated that reputation of a person can be damaged forever once it is besmirched by an unfounded allegation in print media that is quadrupled in circulation through electronic media.

“The Defamatory Articles and Defamatory Videos have lowered the Applicant’s reputation in the eyes of the general public including her fans, followers, brand endorsement companies, business associates and peers who have now started believing in the reports being published by the Defendants,” the plea said.

The application also contended that the defendants are making a mockery of the judicial system by attempting to condemn Shetty and her husband, Raj Kundra as guilty.

“A bare perusal of the Defamatory Articles and Defamatory Videos amply clarify that the Defendants are publishing/ uploading parallel private “investigations” and effectively acting as “courts” to condemn the Applicant and her husband as guilty based on what they claim is “evidence” found by them from their alleged sources, thereby trying to make a mockery of the judicial system,” the plea stated.

Shetty, therefore, sought an injunction against the defendants from further publishing any false or defamatory information.

It was also prayed that the defendants be directed to remove the allegedly defamatory content from their platforms and issue unconditional apologies for the same.

The application also sought directions against social media platforms such as Facebook and YouTube to remove such defamatory content from their platforms.

Details of a multitude of allegedly defamatory reports were also set out in the application.

The matter has been listed to be heard by Justice GS Patel tomorrow.
