The Supreme Court today upheld the Kerala government’s policy to close down all the Bars in the State except those attached to 5 star hotels. A Division Bench of Vikramajit Sen and Shiva Kirti Singh JJ. pronounced its judgment in court room 2 a short while ago..The Kerala government had introduced the policy to curtail liquor consumption in the State but it was met with stiff opposition from the Bar owners who alleged that the policy is discriminatory as it does not include Bars belonging to 5-star hotels..The policy also does not put any restrictions on the sale of liquor through government outlets. Toddy shops are also outside the purview of the ban..The Bar owners had fielded Attorney General Mukul Rohatgi which had invited a lot of criticism, with many questioning the propriety of the Central government’s top law officer appearing for private Bar owners. Besides Rohatgi, Senior Advocates including Aryama Sundaram, Dushyant Dave had appeared for the bar owners..Senior Advocate Kapil Sibal had represented the Kerala government in the Supreme Court..Read the judgment below.
