The Delhi High Court on December 20 extended the interim bail granted to former Bharatiya Janata Party (BJP) MLA Kuldeep Singh Sengar by four weeks in the Unnao rape case [Kuldeep Singh Senger vs Central Bureau Of Investigation]..Sengar is serving life imprisonment after being convicted in the Unnao rape case.He is also serving a ten-year jail term in the case relating to custodial death case of the victim's father.He sought bail in both cases which was heard by different Benches of the High Court.The Court had earlier suspended Sengar's life imprisonment on medical grounds till December 20. He moved the High Court again for 5-month extension of his interim bail.In the rape case, the Division Bench of Justices Pratibha M Singh and Amit Sharma extended the interim bail by four weeks to enable him to recover from the health issues he is facing after an eye surgery and the treatment he underwent for hemorrhoids. “In order to enable the Appellant [Sengar] to recover from his eye surgery, scrotal pain and the bleeding issues that he is facing while defecation (sic), the extension of interim bail for a period of one month is directed,” the Court directed..The Court also allowed Sengar to visit the All India Institute of Medical Sciences (AIIMS) for a follow up medical consultation between January 10 to January 15, 2025 and directed him to surrender himself to the Tihar Jail authorities on January 20, 2025.While extending medical bail, the Court also imposed the following conditions on Sengar: He is not allowed to leave Delhi or change his residence without prior permission of this Court;He shall not move out of his residence except for visiting AIIMS for follow-up treatment;He shall be guarded 24 hours a day by one constable of Delhi Police; He shall not have more than two visitors at a time;A CBI officer shall be in touch with Sengar on a daily basis; and Sengar is permitted to hire only one attendant..The Unnao rape survivor, a minor, was allegedly kidnapped and raped by Sengar between June 11 and June 20, 2017. She was then sold for ₹60,000, after which she was recovered at the Maakhi police station.The survivor was thereafter continuously threatened and warned by the police officials against speaking out, as instructed by Sengar.The case took a controversial turn after a lorry without a number plate rammed into the car in which the victim was traveling. The victim and her lawyer were critically injured, while two of her aunts passed away.In August 2019, the Supreme Court transferred the trial in four cases relating to the Unnao rape case to Delhi and ordered that the same be held on a day-to-day basis and completed within 45 days.Sengar was convicted in December 2019 for the rape of the minor victim as well as for the custodial death of the victim’s father. He was sentenced to life-imprisonment in the rape case and sent to jail for 10 years in the custodial death case..He recently approached the Court seeking medical bail which was granted on December 5 for two weeks.He then moved the Court again seeking extension of the same. On December 19, Sengar’s medical evaluation report conducted by AIIMS was submitted to the Court in sealed covers. As per the medical report, Sengar was said to be in stable condition and it was also stated that he could now be managed as an outpatient at a local facility. The Court also took note of a communication by AIIMS in which it raised concerns regarding large number of visitors coming to meet Sengar and also requesting the Court for security arrangements while Sengar remained in the hospital. .Senior Advocate N Hariharan submitted that Sengar still needs some supervision and care due to the recent laser therapy in his eyes.Advocate Mehmood Pracha appearing for the survivor and CBI’s Special Public Prosecutor opposed the application stating that Sengar’s bail posed a threat to the survivor and her family.The Court after hearing the matter extended the bail for four weeks.The matter will be heard next January 27, 2025..Meanwhile, in the custodial death case, Justice Manoj Kumar Ohri extended Sengar's interim bail till December 23.
